Terms of Use

These terms are the end user licence agreement (EULA) for the Mintdex application.

This text says what Mintdex does, what it does not do, what you can expect from it and what you cannot. Read the part about price estimates in particular: that is the one that matters the day you sell a card.

1. Purpose and acceptance

  • These terms govern access to and use of the Mintdex application and the getmintdex.com website, published by Foosha Studio, a French SASU whose full details appear in the legal notice.
  • You accept them by creating an account, using the app or subscribing to Mintdex+. If you do not agree with them, do not use the app.
  • They are the end user licence agreement for Mintdex on iOS and Android. On iOS, they replace the Apple standard licence agreement for everything they cover, and they never conflict with the Apple Media Services Terms and Conditions.

2. Who you are contracting with

  • This agreement for using Mintdex is concluded between you and Foosha Studio only. It is concluded with neither Apple nor Google. Your download and purchases also create separate agreements with the relevant store.
  • Foosha Studio alone is responsible for the Mintdex application and its content.
  • Apple and Google have no obligation to provide maintenance, support or warranty for the application itself. Mintdex support is hello@getmintdex.com.
  • Foosha Studio, not Apple or Google, is responsible for addressing any claim by you or a third party relating to the application: product liability, failure to conform to a legal or regulatory requirement, and claims arising under consumer protection or data protection law.
  • Foosha Studio, not Apple or Google, is responsible for the investigation, defence, settlement and discharge of any third party claim that the application infringes that third party intellectual property rights.
  • Apple and its subsidiaries are third party beneficiaries of this agreement. Upon your acceptance, Apple has the right to enforce it against you.

3. Your account, your age

  • Mintdex first creates an anonymous account so your collection can be kept without asking for your email address. You can later link it to Sign in with Apple on iOS or Google on Android to retrieve it on compatible devices. You are responsible for keeping your credentials confidential.
  • You must be at least 15 to create an account on your own.
  • If you are under 15, a parent or legal guardian must create the account and use it with you.
  • If you are under 18, you may only subscribe to Mintdex+ with the prior consent of a parent or legal guardian, who then accepts these terms on your behalf. Under French law, an unemancipated minor cannot enter into this kind of contract alone, apart from everyday transactions concluded on normal terms.
  • A note for parents: in-app purchases are handled by the store, not by Mintdex. You can block them or require your approval with Screen Time and Ask to Buy on iOS, or with Google Play and Family Link controls on Android.
  • If a subscription was purchased by a minor without your consent, the refund request goes to the store that charged it: reportaproblem.apple.com on iOS or the Google Play refund flow on Android. Write to hello@getmintdex.com as well: we support the request and close the account if you want us to.

4. The licence we grant you

  • Foosha Studio grants you a personal, non exclusive and non transferable licence to use Mintdex on compatible iOS or Android devices that you own or control, subject to the usage rules of the relevant store.
  • Access from several devices and family features depend on the Apple or Google Account rules that apply. A subscription is shared only where the store and the offer explicitly allow it.
  • The application is licensed to you, not sold to you.
  • You may not resell, sublicense, rent, decompile it or extract its content through automated means, except where the law expressly allows it, including interoperability under the French Intellectual Property Code.
  • You may not extract, copy or reuse the Mintdex card catalogue or price series to build a competing database.

5. What Mintdex does

  • Mintdex identifies a card from a photo, proposes the set, number, language and variant, then shows a price estimate gathered from public sources.
  • Recognition is automatic. It relies on statistical models and it does get things wrong sometimes: wrong variant, wrong language, card missing from the catalogue.
  • It relies on local OCR first. If that is not enough, the image is sent once to Google’s paid Gemini API, whose processing is detailed in the privacy policy and legal notice.
  • Foosha Studio commits to using reasonable efforts to improve recognition and to fix reported errors. That is an obligation of means, not of result.
  • You remain the judge of what you save into your collection. Always check the proposed printing before confirming.
  • Mintdex does not assess whether a card is genuine, its true condition, its centring or its potential grade. A photo does not detect a counterfeit.

6. Price estimates, read this in full

  • This is the most important part of this agreement.
  • Amounts shown in Mintdex are indicative estimates computed from data published by third party sources: Cardmarket, TCGplayer, PriceCharting and, where applicable, other sources named in the app. Every amount shows its source and its date.
  • These estimates are not an appraisal. They are not produced by a professional qualified to value collectibles, and they are not a certificate, an expert report or a statement of value.
  • They are not investment advice, and not a recommendation to buy, sell, hold or grade a card.
  • They are not an offer to buy, not an offer to sell, and not a price commitment by Foosha Studio or by anyone else. Nobody undertakes to buy your card at the price shown.
  • They are not an insurance value and cannot be used as a declared value with an insurer, a public authority or a notary.
  • Foosha Studio neither controls nor validates the data supplied by third party sources. That data can be incomplete, delayed, wrong, interrupted, or relate to a printing close to but different from yours.
  • The real price of a card depends on factors the app cannot see: the exact condition of your copy, its centring, its authenticity, its grade, the state of the market on the day, the buyer in front of you and the sales channel.
  • The total value shown for your collection is a sum of estimates. It inherits all of their limits and is not a certified net worth.
  • Accordingly, the accuracy, timeliness and completeness of estimates fall outside the obligations Foosha Studio undertakes under this agreement. The purpose of the service is to give you a sourced and dated order of magnitude, not a guaranteed price.
  • Any decision to buy, sell, trade, insure, grade or keep a card is yours. Make it after your own checks, comparing several sources and, where the stakes justify it, consulting a professional.
  • What Foosha Studio does commit to: showing the source and date of every amount, writing an estimate as an estimate, and fixing within a reasonable time any faulty data feed reported to hello@getmintdex.com.

7. Your content and your photos

  • Your scan photos and your collection data stay yours.
  • A scan photo is not retained by Mintdex. It is sent to Gemini API only as a last resort; Google may retain the input and output for up to 55 days for safety and abuse monitoring.
  • For that single processing step, you grant Foosha Studio a limited, non exclusive, royalty free licence: send the image to the recognition service and return the result to you. The licence goes no further.
  • None of your photos is used to train or improve a general-purpose model belonging to Foosha Studio, Google or another third party. Google may use monitoring data for systems dedicated to policy enforcement and abuse prevention.
  • For your collection data, you grant Foosha Studio a limited licence to host and process it, for the sole purpose of running the service and syncing it across your devices.
  • These licences end when the content or the account is deleted, subject to technical backups and legal retention obligations.
  • Only scan cards you own or are allowed to photograph. Do not send photos containing a face, an identity document or unlawful content.
  • How personal data is processed is set out in the privacy policy.

8. Intellectual property

  • Mintdex, Minty, the logos, the interface, the texts, the code and the catalogue built by Foosha Studio are protected and remain the property of Foosha Studio.
  • Card names, artwork, illustrations and trademarks belong to Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company International. Mintdex is independent from those companies, with no licence, no affiliation and no endorsement from them.
  • These elements are used only to identify the card you scan. That use is nominative and informational, limited to what identification requires.
  • Artwork shown in the app comes either from your own photos or from third party sources identified in the app.
  • If a rights holder asks for an element to be removed, Foosha Studio removes it and tells you if that changes what you see in the app.

9. Free tier and Mintdex+

  • The free version of the app is available without payment and with no time limit: it is not a trial. It includes 10 discovery scans for the lifetime of your use, up to 100 cards in your collection, 2 binders, 3 watched cards, raw market prices, 30 days of price history and, if you enable them, new-set release notifications.
  • Mintdex+ is an auto renewable subscription that lifts those limits and unlocks graded prices, full history and price alerts.
  • Prices for France, including all taxes: 4.99 EUR per week, 7.99 EUR per month, 49.99 EUR per year.
  • A 3 day free trial is offered only on the annual plan if your App Store or Google Play account is eligible. Weekly and monthly plans are charged immediately. The trial unlocks Mintdex+ and is separate from the free version of the app. An offer already used may no longer appear.
  • At the end of the trial, the annual plan is charged at the then current price unless you cancel within the deadline shown by the store before the trial ends. Any unused part of a trial is forfeited if you subscribe before it ends.
  • The subscription renews automatically at the end of each period unless cancelled within the deadline shown by the store before the current period ends. The Apple or Google Account used for the purchase is charged under the terms displayed when you subscribe.
  • There is no lifetime plan and no way to pay for Mintdex outside the App Store or Google Play.
  • Prices may change. A price change only applies to later periods, after prior notice and under the store rules, which may ask you to confirm the new price.
  • What the free tier and Mintdex+ include may change. If a substantial Mintdex+ feature disappears, you may cancel and ask the relevant store for any refund available for the unused period.

10. Who sells what, and how you cancel

  • Mintdex+ subscriptions are charged by the store used. On iOS, the seller for France is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Republic of Ireland. On Android, Google Play content is offered by Google Commerce Limited, 70 Sir John Rogerson's Quay, Dublin 2, D02R296, Ireland, under the separate agreement shown by Google Play.
  • Foosha Studio publishes the app and grants you the licence. Foosha Studio does not collect your payment and has no access to your payment details.
  • Cancelling: on iOS, open Settings, your name, Subscriptions, Mintdex+, then Cancel Subscription. On Android, open Google Play, your profile, Payments and subscriptions, Subscriptions, Mintdex+, then Cancel subscription. You can also manage a Google Play subscription on play.google.com. Follow the deadline shown by the store to avoid the next renewal.
  • After cancelling, you keep Mintdex+ until the end of the period you already paid for. The account then returns to the free tier. Your collection is not deleted, but Mintdex+ features are no longer available and the free tier limits apply again.
  • Right of withdrawal is exercised under the rules of the store that charged the purchase. On iOS, use reportaproblem.apple.com or Apple Support. On Android, use the Google Play refund flow; the Google Play terms notably explain when immediate access to digital content means waiving the statutory withdrawal right.
  • Refunds are requested from the relevant store, including for an accidental purchase or one made by a minor. Write to hello@getmintdex.com anyway if something went wrong. We answer and handle what belongs to Foosha Studio. A Google Play refund may also be processed by the developer where the applicable rules allow it.
  • The free licence granted by Foosha Studio involves no payment, so there is nothing to refund on that basis.

11. Affiliate links and marketplaces

  • Some buy links to third party marketplaces are affiliate links. They are labelled as such in the app and on the site.
  • The price you pay at the seller stays the same. A commission may go to Foosha Studio if you buy after following such a link.
  • The existence of a commission does not influence the price estimate shown for a card.
  • When you follow an outbound link, you leave Mintdex. The sale is concluded between you and the seller or marketplace concerned, under their own terms. Foosha Studio is not the seller, not a payment intermediary and not a guarantor of the transaction, and does not step into disputes arising from it.
  • Foosha Studio does not control third party sites and is not responsible for their content.

12. Service availability

  • Foosha Studio uses reasonable efforts to keep Mintdex available and working properly. The service is provided without any guarantee of uninterrupted availability.
  • Interruptions can happen for maintenance, updates, technical incidents, failure of a provider or a price source, or force majeure. Where an interruption is planned, you are told in advance when possible.
  • The app evolves. Features can be added, changed or removed. A minimum iOS or Android version is required and may be raised.
  • If the service is interrupted for a prolonged period for a reason attributable to Foosha Studio while you are subscribed, you may cancel and ask the relevant store for any refund available for the period not delivered. Foosha Studio will support your request.

13. Liability

  • Foosha Studio is liable for damage caused by a breach of its own obligations, under ordinary law.
  • Nothing in this agreement limits Foosha Studio liability for personal injury, gross negligence or wilful misconduct, nor deprives a consumer of rights granted by law. Any clause having that effect is deemed unwritten.
  • Under the French Civil Code, compensation covers direct damage that was foreseeable when the contract was concluded, except in cases of gross negligence or wilful misconduct.
  • As set out in article 6, the accuracy of a price estimate falls outside Foosha Studio obligations. A gap between an estimate shown and the price actually obtained in a sale is not, on its own, a breach of contract.
  • Foosha Studio is not liable for matters outside its control: the content and availability of third party price sources, transactions concluded with third parties, failure of your device or connection, or data loss caused by your own actions.
  • You use Mintdex for personal, non professional purposes. If you use it in a professional context, in particular to resell cards, you do so under your sole responsibility and with your own valuation checks.

14. Statutory guarantees

  • You benefit from the statutory guarantees provided by French law, in particular the conformity guarantee for digital content and services under articles L. 224-25-1 and following of the French Consumer Code, and the guarantee against hidden defects.
  • These guarantees are enforced against Foosha Studio, not against Apple or Google.
  • If the application fails to conform to an applicable warranty, you may also notify the store that charged the purchase and request the refund available under its rules. This does not reduce your statutory rights against Foosha Studio.
  • Nothing in this agreement removes or reduces those guarantees.

15. Term, suspension and account closure

  • The agreement starts when you create your account and lasts as long as you use Mintdex.
  • You can delete your account at any time from the app settings. Deletion erases your collection and your account data, with no way back.
  • Important: deleting your Mintdex account does not cancel your subscription. Cancellation must go through your Apple Account or Google Play subscriptions, as described in article 10. Cancel first, then delete.
  • Foosha Studio may suspend or terminate your access for a serious breach of these terms: fraud, attacks on the security of the service, mass data extraction, unlawful content, or use that harms other users.
  • Except in an emergency or a serious breach requiring immediate action, you are warned beforehand and can make your case. The measure is proportionate to the breach.
  • If Foosha Studio terminates your access without any breach on your side, you may ask the relevant store for a refund of the subscription period not delivered.

16. Changes to these terms

  • These terms may change, in particular to follow changes in the service or in the law.
  • You are told about any substantial change before it takes effect, through an in app message or by email, with reasonable notice.
  • If a substantial change does not suit you, you can cancel your subscription as described in article 10 and delete your account.
  • The date of the last update appears at the top of this page.

17. Rules that apply to your use

  • You agree to comply with applicable third party terms when using Mintdex, including those of your carrier, those of Apple or Google depending on your platform, and those of the marketplaces you are directed to.
  • You represent and warrant that you are not located in a country subject to a United States government embargo or designated by that government as a terrorist supporting country, and that you are not listed on any United States government list of prohibited or restricted parties.

18. Governing law and disputes

  • This agreement is governed by French law.
  • If you live in another European Union country, you keep the benefit of the mandatory consumer protection rules of your country of residence.
  • Foosha Studio uses technical providers whose own contracts may be governed by foreign law or subject to arbitration. Those contracts are not enforceable against you. No arbitration clause and no foreign law taken from them applies to the relationship between you and Foosha Studio.
  • If something goes wrong, write to hello@getmintdex.com first. We look for an amicable solution.
  • If the disagreement persists, you can use a consumer mediator free of charge, under article L. 612-1 of the French Consumer Code.
  • The European online dispute resolution platform closed on 20 July 2025 and can no longer be used.
  • Failing agreement, the dispute may be brought before the competent courts. As a consumer, you may bring it before the court where you live.

19. Miscellaneous

  • If a clause of this agreement is held void or deemed unwritten, the other clauses still apply.
  • Not relying on a clause at a given moment does not waive the right to rely on it later.
  • These terms, the privacy policy and the legal notice form the whole agreement between you and Foosha Studio regarding Mintdex.
